. >> announcer: live breaking news. 5 a.m. i'm katie marzullo in for kristen sze. i'm eric thomas that breaking news is in the mission district where police are searching for suspects behind a drive-by shooting that targeted a police officer. terry mcsweeney is live at 23rd and bryant. what is the latest? >> reporter: things are calming down this started 1:30 this morning about 45 minutes ago, they took down the perimeter. never a number of suspects, people of interest they want to be talking to. take a look at the couple of the people in handcuffs a while ago out here near 23rd and york a from 20 nerd and bryant. started 1:-- possibly three

suspects in a moving vehicle shot at a police officer the officer moved around the suspect vehicle to avoid being hit and he was not hit. nobody was hit in this incident. the vehicle with the suspects in it took off, officer followed the car call for back up suspect in custody officers searching for possibly more suspects trying to put this story together. this is all preliminary information. we know that after that chase, we're not sure where those shots were fired. we know it wrapped up a from where i am here down the street at 23rd and york. san francisco police trying to put in situation together. right now i can tell you the perimeter has been taken down. terry mcsweeney, abc7 news. let's get a look at the

reimbursements. maritime director director's $4500 dinner tab at a strip club in 2008 has been under scrutiny. tribune reports the port is investigating whether executive director helped run up the expenditures. he told the tribune he's cooperating but did not respond when asked to deny -- both are on paid leave. san francisco police say a man involved in a mission district brawl last week has died police found him shortly before 2 a.m. october 16th. authorities say 40-year-old man died in the hospital from his injuries. chronicle reports police are treating the death as suspicious not investigating it as a homicide, pending autopsy results. another man treated after the brawl is expected to survive.

police say they think five suspects fled after the fight, no arrests made. highway patrol investigating shooting involving one of its officers. it started when the officer pulled over a driver on highway 29, south of lower lake in lake county yesterday. the vehicle had been reported stolen. the officer says the man went at her started choking her she opened fire and killed him. this is a picture of the scene after reinforce s arrived. the officer is expected to be okay. -- on the campaign trail, president obama and mitt romney are up early crisscrossing battleground states with plans to stump well into tonight. new poll out this morning with mixed news. tahman bradley is live in washington with more. >> reporter: good morning. tracking poll now shows mitt romney leads

game two tonight at&t park 5:07 game three detroit saturday 5:07 our time game four sunday on the road stars at 5:15. the latest on breaking news we've been following all morning from the mission district in san francisco, just learning police have detained two suspects who fired at an officer, allegedly police spokesperson says three people in a car began shooting at the officer in the mission district before 1:30 this morning the officer was not hit he chased the car to 23rd and bryant where one was arrested, two escaped but were taken into custody a short time later. perimeter in the area was taken down within the last hour. terry mcsweeney will have more coming up in our next half hour. this morning police in hercules will try to determine whether a middle school math teacher was selling marijuana to students after he was

busted on campus. 66-year-old allen goodman was pulled out of class yesterday morning after officers found more than a pond of pot in his car which had been left -- than a pound of pot in his car which had been left running in the parking lot. they found $4400 in the glove compartment. police searched his home in walnut creek and found more cash, along with equipment used to grow marijuana. southern california man who broke out of jail, and his wife, have been officially charged by bay area authorities for the murder of a hercules woman. contra costa county prosecutors filed murder charges against 24-year-old darnell washington and his wife tonya in the death of retired schoolteacher susie ko in her home on october 5th. the couple was caught near seattle international airport in ko's stolen suv. washington was awaiting sentence when he brock out of

jail and started north. he's accused -- hughes accused of shooting at a los angeles county sheriff's deputy. six hurt in an overnight crash in san francisco in stable condition. the single car accident happened before 10 last night at 18th and pennsylvania in the vehicle somehow rolled over and ended up on i-280 near mariposa street it closed one southbound lane of 280 and mariposa off-ramp for a time since then it has been cleared. occupy oakland protesters plan to march on the police department and frank ogawa plaza today. one year ago today police tore down their encampment if the plaza prompting violent clashes between officers and demonstrators, 100 were arrested. today occupiers will does in all black and take obvious the plaza at noon followed by a march tonight at 7:00 oakland police will let them go ahead as long as it stays peaceful.
